ACCEPTANCE AND LICENSE

 

These Service Terms ( “Terms” ) apply to the MatchFrenzy app ( “the App” ) provided by Mobile Application Studios, Inc. Mobile Application Studios, Inc.  ( “we”, “us”, “our” ) provides the MatchFrenzy app to you subject to your acceptance of these Terms. This document is a binding contract between you and Mobile Application Studios, Inc.

 

Subject to your agreement and continuing compliance with these Terms, Mobile Application Studios, Inc. grants you a non-exclusive, non-transferable, revocable limited license to access and use the App using a mobile device solely for your own non-commercial entertainment purposes. You agree not to use the App for any other purpose.

 

Mobile Application Studios, Inc. reserves the right to modify or discontinue the App (or any part thereof) with or without notice at any time.

 

We may provide certain products and services for purchase within the App (each an “In-App Purchase”).  In-App Purchases (a) may include additional functionality, content, or subscription access to content or services, (b) can be downloaded only once, and (c) may be subject to additional terms within the In-App Purchase. Once you have received an In-App Purchase, you are responsible for any loss or damage to the In-App Purchase and Mobile Application Studios, Inc. shall have no liability in such circumstances, regardless of cause.  You expressly understand and agree that your use of In App Purchase is at your sole risk and that any In-App Purchase is provided “as is” and “as available”.

 

 

PRIVACY

 

The MatchFrenzy privacy policy explains how we treat your personal data and protect your privacy when you use the application.

 

 

INTELLECTUAL PROPERTY

 

All title, ownership and intellectual property rights in and to the materials contained the App are owned by Mobile Application Studios, Inc. or its licensors. Unless noted otherwise, you should assume that all content, software, and other materials made available or through the App are protected by copyright, trademark and other applicable intellectual property law and may not be used except as permitted in these Terms.

 

 

DISCLAIMER OF WARRANTIES

 

You expressly understand and agree that:

 

1. Your use of the App is at your sole risk. The App is provided on an “As Is” and “As Available” basis. Mobile Application Studios, Inc. expressly disclaims all warranties expressed or implied, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
2. Any content downloaded through In-App Purchases is downloaded and used at your sole discretion and risk.
3. No advice or information, whether oral or written, obtained by you from Mobile Application Studios, Inc. or through or from the App shall create any warranty not expressly stated in these Service Terms.

 

 

GOVERNING LAW

 

This Agreement is governed in accordance with the laws of New York, United States of America.

 

 

CHANGES TO SERVICE TERMS

 

We may update the Terms by providing a new version on this website. Your continued use of the MatchFrenzy app after any such update constitutes your binding acceptance of such changes.
